To sue or not to sue

So after getting a routine pedicure my sister’s big toe is now infected. The week of Thanksgiving she was hobbling around talking about her toe was hurting. It was to the point I gave up my favorite pair of flat boots because I didn’t want her going anywhere with me in some grandma looking flat she was borrowing from my mama. Supposedly, when she was getting a pedicure the nail technician pulled a piece of skin off her toe. My sister said she told the woman that it hurt when she did that and the woman proceeded to say it was dead skin. My sister’s toe ain’t been right since and that was three weeks ago.

Finally, everybody talked her into letting us see it. All of us agreed that the lil swollen part was possibly infected. My daddy was like yep, ooo weee thats an infection. I was teasing and kept saying that somebody needed to stick a needle in there to see if it would drain. She thought I was crazy. My grandmother called herself doctoring it up and told my sis she would probably have to get some antibiotics. Of course my sister was in denial thinking it was gonna eventually heal. However, her toe kept hurting.

She called me on Monday and said that she was at Urgent Care. They numbed her foot and proceeded to lance it. I knew she should have let somebody pop it. She said it was so much puss and blood that came out of her foot. It was to the point that the nurse didn’t want her to look while she was draining it. Once they drained it then they packed it and gave her some antibiotics.

Instead of resting her foot my sister still been hobbling around everywhere. Mad she had to call off from her part time. I told her she better be thankful she still got her big toe. She called me today and said that she could no longer be super worker of the day because the pain medicine was making her sick and she left work to go home and finally prop that foot up.

So now, all on facebook and everytime she mention to somebody what happened to her foot people are saying you know that’s a lawsuit. A friend even had a lawyer call her and say at least let me get you some money for your pain and suffering. Thing is a lawsuit never popped in my sister’s mind, my mind, or anybody in my family’s mind. My thing is you know the risk when you set foot in a nail salon to get a pedicure. You hope that they are using sterilized equipment but you really don’t know for sure.

Me and my sister laugh about it when she asks what should she do. I’m like if you do sue then you can never ever get another pedicure.  I just don’t see how you could sue and still get pedicures. And she’s like that’s exactly how she feels. The doctor did write her up something saying that she did have an infection that was caused by her pedicure. As of now, she said she’s only going to ask if they’ll pay for her doctor bill.

If this was your big toe. What would you do? Do you think people are too sue happy these days? Are you scared of possible infections from pedicures? Talk to me…..

    I think she can sue… if only because it will scare the nail salons people into doing something about being sanitary… She can get some type of settlement out of it, and then change nail salons. It could have been worse!

    I knew I would be grossed out reading this. Ewwwwwwwwww.

    As for suing, I’m on the fence. I would definitely let the salon know what was up. I would probably make the decision based on their reaction.

    My initial thought wouldn’t be to sue either. Nail salons in general scare me. I like the ones that let you keep the equipment they use on you. Or at least store it until you come in again.

    My stomach is still turning 😦

    @LP…. You are absolutely correct.

    Nail salons in general scare me. I like the ones that let you keep the equipment they use on you. Or at least store it until you come in again.

    @V.. I agree with this too. I feel like you know the risk when you walk into the nail salon. After this I would probably invest in my own supplies. I wouldn’t even leave them there I would prefer to take them with me. Ain’t no telling what they doing to the supplies that they have “stored”.

    ********UPDATE**********

    Yesterday my sis called me and stated that she was on her way to the nail salon with her documentation. She want them to cover her doctor bills and loss wages. She asked me how much should she ask for regarding her pain and suffering. I told her I honestly didn’t know and didn’t have an answer for her. She talking about what you don’t have anything to say. Suprisingly, I really didn’t know what to say……. Anywho, the manager wasn’t there and is supposed to get back to her. So I’ll keep you guys updated.
